Full implementation of electronic registration certificate of medical devices

On October 26, the State Food and Drug Administration issued the Announcement on the Full Implementation of Electronic Registration Certificate of Medical Devices (hereinafter referred to as the Announcement), which stated that, on the basis of summarizing the early pilot issuance and application, the study decided to fully implement the electronic registration certificate of medical devices from November 1, 2022

AMENDMENT OF THE EXPORT ADMINISTRATION REGULATIONS IN THE UNITED STATES OF AMERICA

On October 7, the U.S. Department of Commerce announced that it would revise the U.S. Export Administration Regulations, upgrade export control measures to China, and upgrade semiconductor export controls to China. It would not only add new controlled items, but also expand export controls involving supercomputers and semiconductor production end uses. The United States suspends tariffs on photovoltaic modules imported from Southeast Asia

The US Department of Commerce finally determined the proposed regulations (final rules) to implement Presidential Bulletin 10414, exempt the batteries and components imported from Southeast Asia from anti circumvention or anti-dumping duties, and add new scope of application.
Regulation No. 10414 stipulates that the crystalline silicon photovoltaic cells and modules that have been partially or completely assembled from Thailand, Vietnam, Malaysia and Cambodia and exported to the United States are exempted from tariffs for two years. Another important condition is that, in order to qualify for this exemption, batteries and components completed in Southeast Asia "must be used in the United States before the expiration date", that is, they must be installed within 180 days after the termination date. That is to say, assuming the exemption is terminated on June 6, 2024, the battery modules completed in Southeast Asia must be used before December 3, 2024.
The "final rule" stipulates that if the circumvention is determined, the Southeast Asian batteries and components entering the United States before the termination date will not be subject to anti-dumping and countervailing duties.
According to statistics, the manufacturing capacity of crystalline silicon modules in the United States is only 5GW, and that of thin film modules is about 2.5GW. Although China accounts for less than 5% of the import sources, more than 80% of the products come from Southeast Asia, where Chinese photovoltaic enterprises set up factories.


Argentina further strengthens import control

Ethiopia prohibits banks from issuing letters of credit for some imported products


The Ministry of Finance Ethiopia (MoF) announced on October 4 that the banks of Ethiopia were prohibited from issuing letters of credit for the import of 38 products on the grounds that "domestic foreign exchange is insufficient, foreign exchange should be reserved for priority imported products, and these products are non priority necessary imported products".

Tunisia conducts prior inspection on imports

The Ministry of Trade and Export Development, the Ministry of Industry, Mining and Energy and the Ministry of Health of Tunisia, Africa, issued a statement recently, officially announcing the decision to adopt a prior inspection system for imported products, and stipulating that products should be imported directly from factories in the exporting country. 
 
Other provisions also include the need to provide the competent authorities with invoices for the import of relevant products, including the Ministry of Trade and Export Development, the Ministry of Industry, Mining and Energy, and the National Food Safety Administration.

In addition, it also includes the declaration of the category of imported products, the trademark of the product and the trademark authorized by the owner. Approve the samples of imported products, and the documents and reports certifying that the quality of imported products conforms to the use standards issued by the government of the exporting country.

The following cases are not subject to the regulations: import from national institutions, public institutions and local authorities; Import raw materials and semi-finished products for the industrial sector and related services as well as the handicraft sector; Import raw materials, semi-finished products and spare parts; Imported equipment for renewable energy production projects; Imports without payment or currency transfer; Benefit from duty-free imports, such as embassies and similar institutions.


License is required for importing unmanned aircraft from Vietnam


The General Administration of Customs of Vietnam requires all customs units to agree on the management of UAVs and ultra light aircraft in accordance with the No. 36/2008/ND-CP of the Vietnamese government, and on the implementation rules of the Foreign Trade Administration Law in accordance with the No. 69/2018/ND-CP of the Vietnamese government, The Ministry of Information and Communications of Vietnam issued Announcement No. 02/2022/TT-BTTTT on May 16, 2022, which stipulated that the import of unmanned aerial vehicles (Flycam) should be handled in accordance with the provisions of such legal documents as the List of Products and Goods that May Cause Safety Out of Control, which are under the management of the Ministry of Information and Communications of Vietnam.

According to the provisions of the above documents, when registering the import declaration form, the declarant must hold the import license issued by the competent authority that has reached a consensus with the Ministry of Public Security and the Ministry of National Defense of Vietnam, and fill in the license number on the import declaration form.

In addition, when handling customs formalities, the declarant must submit the Application for Inspection by the State Administration of Quality through the customs electronic information processing system.

With regard to the classification of products and goods and the applicable tax policies, the Vietnam General Administration of Customs requires all customs units to handle uniformly according to the letter of the General Administration of Customs No. 3831/TCHQ-XNK dated September 15, 2022.
